Terms of Service

By accessing and using Histitch ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

We reserve the right to modify these Terms at any time. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

Histitch is a crowdfunding platform for fashion designers. Designers create and launch designs, and supporters can pre-order these designs. Designs are only produced if they reach their funding goal.

Key concepts:

• Designs: Fashion items created by designers and listed on the platform
• Orders: Pre-orders placed by supporters for designs
• Funding goal: The minimum number of orders needed for a design to go into production
• Designers: Verified users who create and launch designs

Account Creation

You must create an account to use certain features of the Platform. You are responsible for maintaining the security of your account and password.

Account Requirements

• You must be at least 13 years old
• You must provide accurate and complete information
• You must not impersonate others or create fake accounts
• Each person may only have one account

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

Placing Orders

When you place an order:

• You are pre-ordering a design that may or may not be produced
• You will be charged immediately when you place the order
• The design will only be produced if it reaches its funding goal
• If the funding goal is not met, you will receive a full refund

Pricing

Prices are set by designers and displayed in USD. All prices include applicable taxes unless otherwise stated. Shipping costs are calculated at checkout.

Payment Processing

Payments are processed securely through Stripe. We do not store your payment information. By placing an order, you agree to Stripe's terms of service.

Refunds

You may request a refund:

• Before the design goes into production
• If the design does not reach its funding goal (automatic refund)
• If the designer cancels the design
• Within 30 days of receiving a defective item

Refunds are not available once production has started.

If you are a designer on the Platform, you agree to:

• Create original designs that do not infringe on others' intellectual property
• Accurately represent your designs with photos and descriptions
• Set realistic funding goals and production timelines
• Fulfill all orders in a timely manner
• Maintain quality standards for produced items
• Communicate with supporters about production and shipping
• Handle customer service issues professionally

Designer Fees

Histitch charges a platform fee on successfully funded designs. Current fees are displayed during the design creation process.

Your Content

You retain ownership of content you upload (designs, photos, descriptions). By uploading content, you grant Histitch a license to use, display, and distribute your content on the Platform.

Platform Content

The Histitch platform, including its design, code, and branding, is protected by copyright and other intellectual property rights. You may not copy, modify, or distribute our platform content without permission.

Copyright Infringement

We respect intellectual property rights. If you believe your work has been infringed, please contact us at support@histitch.studio with details.

You may not:

• Use the Platform for illegal purposes
• Sell counterfeit or stolen goods
• Engage in fraudulent activity
• Harass or abuse other users
• Spam or send unsolicited messages
• Upload malware or harmful code
• Scrape or collect data from the Platform
• Circumvent security measures
• Impersonate others

Designers are responsible for shipping orders to supporters. Estimated delivery times are provided by designers and are not guaranteed.

If you do not receive your order within a reasonable time after the estimated delivery date, please contact the designer or our support team.

Histitch acts as a platform connecting designers and supporters. We are not responsible for:

• Quality, safety, or legality of designs
• Accuracy of designer information or timelines
• Disputes between designers and supporters
• Failure of designers to fulfill orders
• Shipping delays or lost packages

To the maximum extent permitted by law, Histitch shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

If you have a dispute with a designer or another user, we encourage you to contact them directly first. If you cannot resolve the issue, please contact our support team.

Any disputes arising from these Terms shall be governed by the laws of the United States and the State of California.

Your use of the Platform is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.
